Starting 2 December 2024, Spain's Real Decreto 933/2021 imposes new obligations on businesses and individuals managing tourist accommodation or vehicle rentals.
This update aims to enhance public safety by creating a centralised registry for guest and rental data.
As a property manager overseeing short-term rentals, here is what you need to know to stay compliant.
Who is affected?
The law applies to anyone managing:
- hotels, hostels, pensions, rural homes and campsites,
- apartments listed on platforms like Airbnb or Booking, and
- agencies handling vehicle rentals without drivers.
What information must be collected?
For guest accommodation, property managers are required to gather and report guest and booking information.
Personal data
- Full name, gender and nationality.
- Date of birth.
- Type and number of identification document, such as passport or ID.
- Full residential address, including street, city and country.
- Contact information, including phone numbers and email address.
- Relationship to minors in the group, if applicable.
Booking details
- Check-in and check-out dates and times.
- Payment details, including type of payment, card details and transaction reference.
Vehicle rentals
If vehicle rentals without drivers are also part of the activity, additional information may be required.
- Driver information: full name, gender, nationality, date of birth, identification details and contact information.
- Vehicle details: licence plate, model, colour and mileage at rental start and end.
- Rental transaction details: contract reference number, rental start and end dates, payment method and payment details.
Why is this important?
The Spanish Ministry of the Interior has emphasised that this measure is intended to assist in preventing serious crime and terrorist activities.
At the same time, the hospitality and travel sectors have raised concerns about increased administrative burdens and potential privacy risks.
